These Terms and Conditions ("Terms") govern your use of the website www.sereneimages.info (the "Site") and the professional organizing and spatial design services (the "Services") provided by Serene Images LLC ("Serene Images," "we," "us," or "our"). By accessing the Site or engaging our Services, you agree to be bound by these Terms.
Serene Images LLC is a limited liability company organized and existing under the laws of the State of New York.
By accessing or using our Site, submitting a consultation request, or engaging our Services, you represent that you are at least 18 years of age and agree to these Terms in full. If you do not agree to these Terms, you must not use the Site or engage our Services.
Serene Images provides professional home organizing, spatial design, and decluttering services for residential clients across the United States. Our services include, but are not limited to:
The specific scope, timeline, and pricing of Services are detailed in the Spatial Design Blueprint provided to each client prior to project commencement. The Blueprint, once approved by the client, forms a binding part of these Terms.
All engagements begin with a complimentary Discovery Call. This call does not constitute a binding agreement. A binding agreement is formed only upon: (a) mutual approval of the Spatial Design Blueprint; (b) receipt of the required deposit; and (c) confirmation of project dates. These three conditions together constitute the "Service Agreement."
All prices quoted in our Spatial Design Blueprint are in United States Dollars (USD) and are exclusive of applicable state and local sales taxes unless otherwise stated. Payment terms are as follows:
We accept payment by personal or business check, bank transfer (ACH), Visa, Mastercard, American Express, and Discover. Late payments may incur a fee of 1.5% per month on the outstanding balance.
Our cancellation and refund terms are detailed in our Refund Policy, which is incorporated into these Terms by reference.
By engaging our Services, you agree to:
Serene Images carries comprehensive general liability insurance with a $2,000,000 aggregate policy and professional liability (errors and omissions) coverage. We are bonded through a surety bond issued by a licensed bonding company in the State of New York.
While we exercise the utmost care in handling your possessions, our liability for any damage to personal property during the course of our work is limited to the lesser of: (a) the fair market value of the damaged item at the time of damage; or (b) $5,000 per item, with a maximum aggregate liability of $25,000 per project. Claims for damage must be reported in writing within seven (7) business days of project completion.
All content on the Site — including text, graphics, logos, images, design elements, and software — is the property of Serene Images LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our prior written consent.
The Spatial Design Blueprint and Household Maintenance Manual provided to clients are proprietary documents intended for the client's personal use only. Redistribution, publication, or commercial use of these documents is prohibited.
With your written consent, we may photograph completed projects for use in our portfolio, marketing materials, and social media channels. All photographs will be reviewed with you prior to publication, and we will never disclose your name, address, or identifying details without explicit permission. If you prefer not to participate, simply let us know — your decision will not affect the quality or scope of our services.
The Site and its contents are provided on an "as is" and "as available" basis. Serene Images makes no representations or warranties of any kind, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of the Site or the information, products, services, or related graphics contained on the Site. To the fullest extent permitted by law, Serene Images disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Serene Images LLC, its members, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of (or inability to access or use) the Site; (b) any conduct or content of any third party on the Site; or (c) unauthorized access, use, or alteration of your transmissions or content.
You agree to indemnify, defend, and hold harmless Serene Images LLC, its members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the County of New York, State of New York, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and any approved Spatial Design Blueprint, constitute the entire agreement between you and Serene Images LLC regarding the use of the Site and the provision of Services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes.
